NEW YORK – A New York City grand jury on Wednesday indicted former U.S. Marine Daniel Penny in a subway choking death last month, according to published reports.<\/p>\n

Penny was charged with second-degree manslaughter in the May 1 death of Jordan Neely. He has been released on bail. CNN<\/a> reported<\/p>\n Neely, 30, died of “neck compression (asphyxiation),” according to the medical examiner’s office.
