NEW YORK – A New York City grand jury on Wednesday indicted former U.S. Marine Daniel Penny in a subway choking death last month, according to published reports.

Penny was charged with second-degree manslaughter in the May 1 death of Jordan Neely. NBC news i CNN reported, citing unidentified sources.
WCBS-TVciting Neely’s family attorney, said a Manhattan grand jury indicted Penny.

A representative for Manhattan District Attorney Alvin Bragg declined to comment NBC news. A spokesman for Penny also declined to comment to the news organization.
Penny, 24, was initially arrested on a charge of second-degree manslaughter, she said ABC News. He has been released on bail. CNN reported
Neely, 30, died of “neck compression (asphyxiation),” according to the medical examiner’s office. WCBS reported His death was ruled a homicide, authorities said.
Neely was riding a northbound F train in Manhattan on May 1 when police said he began “acting erratically” around 2:30 p.m. EDT. WABC-TV reported
“I don’t have food, I don’t have to drink, I’m fed up … I don’t care about going to jail and staying in prison for life … I’m ready to die,” Neely said. a video recorded by Juan Alberto Vazquez, freelance journalist. Vazquez posted the incident on his Facebook page, “Luces de Nueva York,” he said The New York Times.
In Vazquez’s video, Neely can be seen flailing her arms and kicking her legs as she tried to free herself from the grips of a man, later identified as Penny, the time reported
Neely eventually lost consciousness and was taken to Lenox Hill Hospital, where he was pronounced dead. WABC reported
