The judge denies preventive detention to the Jemez man accused of repeatedly breaching the conditions of release

ALBUQUERQUE, NM (KRQE) – A man accused of rape in 2019 remains out of jail despite repeatedly violating his release conditions. Prosecutors are back in front of a judge this morning, asking him to get Anthony Casiquito off the street, but their request has been denied again.

This is the seventh time the district attorney’s office has asked a judge to put Anthony Casiquito back behind bars, saying he is breaking the rules by using drugs and drinking. Bernalillo County District Attorney Raul Torrez says Anthony Casiquito has had break after break.

Casqiquito is awaiting trial for rape. A woman claims he put her hand down her pants while they were both patients at Westside Hospital in Lovelace in 2019. Prosecutors then asked that Casiquito be held pending trial, but their request was denied and they let him go with conditions of release. In December 2019, he was ordered back to prison for a drug treatment program and released 30 days later.

Since then he has broken these rules more than once, including in 2020 when he tried to steal a car and in 2022 when he was caught throwing rocks at police cars. In these two cases he was accused of robbery and aggravated assault of a police officer.

For the seventh time since 2019, the state asked a judge to lock him up again after he tested positive for methamphetamine again.

“He appears to have a pretty severe addiction to methamphetamine,” Torrez said. He has tested positive for methamphetamine again,” he said.

Casiquito’s attorney told Judge Fox that Casiquito has done everything the court has asked of him, except conquer his addiction. Although this is the seventh time prosecutors have made this request, Judge Fox denied the motion, giving Casiquito another chance to clean up his act.

Casiquito is due back in court at the end of August for an evidentiary hearing where they will change how often he is drug tested. It is not known when his trial will be, it was reset in July due to exposure to Covid.
