UPPER EAST SIDE, Manhattan (WABC) — A grand jury is expected to decide whether Marine – Daniel Penny, 24, will face criminal charges in the death of Jordan Neely, 30, aboard a subway train.
Among the considerations, did Neely pose a threat to the safety of other passengers and did Penny use excessive force when she allegedly held Neely in that hold for about 15 minutes?
The story sparked protests this weekend that descended on the Lexington Avenue/63rd Street station and on the tracks, forcing trains to stop.
The NYPD is now looking for six people involved in this protest.

As protesters screamed, friends recalled a street performer who impersonated Michael Jackson.
However, police records point to an increasingly violent man: Neely was arrested more than 40 times for multiple assaults, attempted child abduction, drugs and indecent exposure.
Detectives are also trying to determine if he tried to push a passenger onto the tracks the day before Neely died. There was currently a warrant out for Neely’s arrest in the violent attack of an elderly woman.
Friends say Neely was in desperate need of psychiatric help.
“Really worried about him the last time I saw him. He said, ‘I’m going to make it, trust me,'” Moses Harper said.
